Terms of Service

1. Agreement

By accessing or using Petive, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions, please do not use the service.

2. The Service

Petive helps you organize pet care information, collaborate with your household, and use AI features to assist in pet management. Petive is available as a free service with optional premium subscriptions.

Petive is not veterinary care. It does not provide veterinary diagnosis, treatment, emergency care, or professional medical advice. Luna and other guidance features are informational only. Contact a veterinarian or emergency animal hospital for medical questions or urgent symptoms.

3. Eligibility

You must be at least 13 years old (or 16 in the EEA) to use Petive. By using Petive, you confirm that you meet this age requirement.

4. Accounts and Security

You are responsible for the accuracy of information you add to Petive and for keeping your account secure. When you invite someone to a Shared Pack or household, that person may see pet care records available to that household.

5. Acceptable Use

You agree not to post unlawful, harmful, abusive, misleading, private, or infringing content. You may not scrape, automate access, reverse engineer, or bypass security measures.

Petive may remove content, restrict access, or suspend accounts when needed to protect users, pets, the service, or our legal rights.

6. Your Content

You retain ownership of the content you submit (such as photos, text, and logs). By submitting content, you grant Petive a limited, non-exclusive license to process, store, and display it solely to provide the service.

We do not use your personal data or uploaded content to train our own or third-party AI models.

7. Generated Output

You own any output generated by our AI features. Because output is AI-generated, you are responsible for verifying its accuracy before relying on it.

8. AI Disclaimer

Luna processes typed questions and, when you choose to provide it, typed food-label context using a probabilistic AI model. It does not diagnose, prescribe, calculate medication doses, scan food with a camera, or replace veterinary care. Output may be incomplete or inaccurate. Always verify medical and safety decisions with a qualified veterinarian.

9. Third-Party Services

We use third-party services including Apple for billing and Groq for AI inference. Petive does not submit your data for model training or fine-tuning. Groq's current inference retention and data controls are described in Petive's Privacy Policy.

10. Purchases and Subscriptions

Paid features are offered through in-app purchases or subscriptions billed by Apple. Purchase terms, renewal, cancellation, and refund handling are managed by Apple as described on our Purchases page.

11. Intellectual Property

Petive, the website, app design, brand, and related content are owned by Petive or its licensors. You have no license to copy, modify, or redistribute our intellectual property without permission.

12. Termination

We may terminate or suspend your access immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the service will cease immediately.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN 'AS IS' AND 'AS AVAILABLE' BASIS, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. PETIVE DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

14. Limitation of Liability

To the maximum extent permitted by law, Petive shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so the above limitations may not apply to you.

15. Indemnity

You agree to defend, indemnify, and hold harmless Petive and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses resulting from your use of the service or breach of these Terms.

16. Governing Law & Venue

These Terms shall be governed by the laws of the United States. Disputes will be brought exclusively in the applicable state or federal courts. Where a party is unable to bring a claim, the parties consent to binding arbitration as the alternate forum.

17. Changes to Terms

We reserve the right to update these Terms at any time. Material changes will be posted with a new 'Last updated' date. Your continued use of Petive after changes are posted constitutes your acceptance of the revised Terms.
